The court in that case found a violation of Article 11 of the European Convention on Human Rights (freedom of assembly and association).
According to the facts of the case, the main opposition party, “Cumhuriyet Halk Partisi” the years 2007 – 2009 has been subject to an inspection of its finances. The ECtHR because of the importance of the parties in the republics accepted that despite the fact that there should be provisions for financial party control, this provisions should be so formulated as to provide a significant and clear interpretation for their application. In the case of the party the provisions on unlawful expenditure were not clear.
